Andrew is highly experienced in handling complex litigation from start to finish and at all levels in between.

Andrew Petersen is a trial and appellate lawyer with over a decade of experience representing trucking companies, international and domestic manufacturers, nursing homes, and businesses in personal injury, professional and commercial litigation in both State and Federal Courts around the country including cases in Texas, New Mexico, Oklahoma, Arkansas, Louisiana, Kansas and California. He has also been engaged to represent Architects, Engineers and Contractors in professional liability and personal injury matters involving multi-million dollar claims and even fatalities.

Andrew is dedicated to bringing cases to a just resolution as efficiently as possible. His method for accomplishing this result is to look at all levels of a case from the time it walks in the door for the purpose of charting multiple pathways to success including obtaining dismissals, reasonable settlements, favorable verdicts or appellate decisions or even avoiding suit entirely.

Andrew has represented many Fortune 500 companies including dedicated motor carriers, package-delivery companies, load brokers and companies with their own non-commercial fleets in transportation matters across the country. From massive pileups involving over a hundred vehicles to simpler matters involving a disputed lane change, Andrew has extensive experience in directing and litigating these matters including engaging in complex State and Federal motion practice, multi-district litigation, aggressively defending claimed traumatic brain injury (TBI) cases and getting to the bottom of claimed medical expenses. Andrew’s reputation in the industry has led to him being named a Texas Rising Star in Transportation and Maritime Law in 2018, 2019, 2020, 2021, and 2022, an award which is only given to the top 2.5% of attorneys in Texas that are 40 years or younger or in the first 10 years of their practice.

Andrew has likewise represented many large manufacturing companies in products liability actions including automobile manufacturers, agricultural equipment manufacturers, medical device manufacturers, and overseas manufacturers from Japan and Taiwan. Whether it’s bet the company litigation involving large scale recalls and catastrophic injuries to single incident alleged product failures resulting in property damage, Andrew has the experience and knowledge to protect and direct your company through the seeming chaos of litigation.

Andrew has also successfully litigated and resolved multi-million dollar claims and lawsuits involving oil field litigation, nursing homes, hospitals, commercial litigation, premises liability, dram shop litigation and other catastrophic personal injury matters.

The full-service nature of Andrew’s practice includes working to protect his clients at both the trial and appellate levels. Andrew has successfully handled appeals in a variety of matters including addressing interlocutory and mandamus issues as needed throughout the course of a case.

Andrew’s passion for the art of argument manifested with his High School Debate Coach convincing him to join the debate team where he won several competitions, to college where he convinced the school to start its very own Ethics Bowl Team which placed in the regional competition in its formative year before being invited to Nationals, to his law school career at Baylor University School of Law where he competed and received awards in intramural and extra-curricular moot court and mock trial competitions before graduating with honors.

Andrew grew up an Air Force kid and lived in Germany, Nebraska, Missouri, California, and Florida before moving to Texas for law school. Outside of the office he enjoys traveling and spending time with his wife Cara and their children. Thanks primarily to his time growing up and his first job out of law school (which required heavy traveling), Andrew has visited 44 of 50 States and plans to get the full set as soon as possible.

Representative Experience

• Won Traditional and No Evidence Motions for Summary Judgment on behalf of truck driver and trucking company resulting in almost all of the plaintiffs' claims being dismissed, including gross negligence. Shortly thereafter, the case resolved for pennies on the dollar in comparison with Plaintiffs' demands;
• Won No Evidence Motion for Summary Judgment for insured truck driver and motor carrier and obtained a dismissal with prejudice of all of Plaintiff’s claims regarding the underlying collision;
• Won Motion for Sanctions seeking Dismissal with Prejudice (Death Penalty Sanctions) after Plaintiffs improperly non-suited the case to avoid summary judgment in suit where the contract driver was traveling through a red light at the time of the accident;
• Won Traditional and No Evidence Summary Judgment on issues of course and scope of employment and negligence on behalf of Fortune 500 Pest Control Company in case involving motor vehicle accident and case valued by Plaintiffs at over $10,000,000;
• Won Motion to Dismiss with Prejudice on behalf of trucking company in suit where Plaintiff was an unauthorized passenger in the tractor when it rolled over in single vehicle accident;
• Won Motion for Summary Judgment in Federal Court in products liability matter for Fortune 500 Employee Uniform Manufacturer and Service Provider where suit alleged faulty uniform resulted in Plaintiff’s burn injuries;
• Won Motion to Dismiss with Prejudice based on Texas Anti-SLAPP Statute in suit brought against witnesses who testified in an arbitration proceeding;
• Won Motion to Dismiss with Prejudice based on Chapter 74 in suit against nurse including award of attorneys fees which resulted in full agreed dismissal of claims against nursing home with prejudice;
• Won Motion for Summary Judgment for national luxury hotel chain on issue of premises liability claim involving Plaintiff claiming serious bodily injury from fall;
• Won Motion for Summary Judgment for national grocery store chain on issue of premises liability claim involving Plaintiff claiming serious bodily injury from fall;
• Aggressively litigated breach of contract and wrongful foreclosure action which resulted in non-suit with prejudice;
• Won Motion for Sanctions which resulted in dismissal of claims with prejudice and award of $7,000 in attorneys’ fees against a Plaintiff asserting wrongful foreclosure and breach of contract;
• Won Motion for Summary Judgment for entertainment venue on issue of negligent hiring/supervision of employees and staff;
• Won appellate victory on Motion to Transfer Venue on issue of whether a non-governmental entity can assert the mandatory venue provisions of the Texas Tort Claims Act when a governmental entity waives the right to assert mandatory venue. In re Hubbard, 05-14-00608-CV, 2014 WL 4090131 (Tex. App.—Dallas Aug. 19, 2014), reconsideration en banc denied (Sept. 18, 2014), mandamus denied (Oct. 10, 2014).
• Won appellate victory in the U.S. Fifth Circuit Court of Appeals on behalf of Fortune 500 Employee Uniform Manufacturer and Service Provider where suit alleged faulty uniform resulted in Plaintiff’s burn injuries, Young v. Cintas Corp. No. Two, 786 Fed. Appx. 466, 467 (5th Cir. 2019)
• Won appellate victory in the Texarkana Court of Appeals with Petition Denied by the Texas Supreme Court while defending the Trial Court’s grant of dismissal with prejudice as sanction for Plaintiffs improperly non-suiting the case to avoid summary judgment; Cox v. Vanderburg, No. 06-20-00078-CV, 2021 WL 4055487 (Tex. App.—Texarkana Sept. 7, 2021, pet. denied), reh'g denied (Sept. 28, 2021);
• Won appellate victory in the Tyler Court of Appeals following Oral Argument on behalf of Fortune 500 Pest Control Company in case involving motor vehicle accident and case valued by Plaintiffs at over $10,000,000; Breedlove v. Moffitt, No. 12-21-00037-CV, 2022 WL 1286564, at *1 (Tex. App.—Tyler Apr. 29, 2022, no pet. h.)
• Litigated dozens upon dozens of complex transportation, products liability, healthcare, commercial litigation, oil field injury and other claims/lawsuits including fatalities, catastrophic personal injuries, traumatic brain injuries, multiple amputations and a host of other claimed injuries resulting in reasonable settlements on behalf of my clients.
